Outcome: After a week-long jury trial including testimony of eight witnesses for the State, Mr. Grostyan gave a closing argument that convinced the jury to find his client NOT GUILTY of Felony Domestic Assault by Strangulation.

Outcome: Prosecutor offered a plea to Felony and several years in prison. Mr. Grostyan attacked the truthfulness of the alleged victim’s statements. Both Felony charges were dismissed. Client pled to misdemeanor causing fear of domestic assault with no prison or jail time.

Charges:  Felony Possession and Sale of Methamphetamine – First Degree
Outcome:  Client was facing mandatory 130 months in prison.  Mr. Grostyan prepared motions to suppress evidence from trial which resulted in an agreement with the County Attorney to dismiss the First Degree Controlled Substance charges and plead to a lesser charge without any prison or jail time.

Outcome:  Client was facing a presumptive commit to prison for 70-80 months.  Mr. Grostyan was able to obtain a dispositional departure for his client which meant no prison and not one day in jail.

Charges: Conspiracy to distribute over 500 grams or more of cocaine
Outcome: Client was facing a 34 year federal prison sentence.  Attorney Grostyan successfully argued for a departure from the U.S. Attorney’s recommendation from 34 years to 9 years.

Outcome: Probation officer asked judge to impose 180 days of jail for client’s failure to stay in contact with probation for three years and failure to follow any recommendations of probation. Mr. Grostyan convinced the judge to take his client off probation without any jail or penalties.

Outcome:  Attorney Anthony Grostyan argued that the window tint statute was unconstitutionally vague and the state could not prove the speeding charge. Defendant was acquitted of both charges.

Outcome: A conviction on the Possession of Marijuana in a Motor Vehicle would have resulted in a driver’s license revocation for the client. Mr. Grostyan was able to successfully negotiate a resolution whereby the client would pay a fine on the Petty Misdemeanor Possession of Drug Paraphernalia, which is not considered a crime, and the Misdemeanor Possession of Marijuana in a Motor Vehicle charge was dismissed. The client did not incur a driver’s license revocation. In addition, the client lived out-of-state and the matter resolved without the client returning to Minnesota to deal with the charges.

Outcome: Client had no defenses available. Mr. Grostyan was able to work with the County Attorney to see that the client was not also charged with a felony burglary charge in exchange for client’s guilty plea on possession of burglary tools. Client was not required to serve any additional jail time as a result of conviction.

Outcome: Client plead to Felony DWI Refusal charge and the Felony Fleeing a Peace Officer charge was dismissed. Client was ordered to serve 45 days in the workhouse work release, and was able to serve another 75 days on electronic home monitoring. Client did not have to serve any jail or prison time.
